Terms of Service

The rules for using BriefNest — plain where we can be, precise where we have to be.

1.Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of BriefNest’s mobile applications, website, and related services (together, the “Service”), provided by BriefNest, Inc. (“BriefNest,” “we,” “us,” or “our”). By creating an account, recording a meeting, uploading a transcript, or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization, and “you” refers to both you and that organization.

If you do not agree to these Terms, do not use the Service.

2.What BriefNest does

BriefNest helps you capture and understand meetings. You can record audio on your phone, scan handwritten notes, or paste an existing transcript, and BriefNest uses automated processing — including AI models — to generate a summary (“brief”), key points, decisions, and suggested action items. You can then ask questions about a brief in natural language and export it to tools like Slack, Notion, Linear, or Jira.

BriefNest does not join your meetings as a bot or third-party participant. Recording is initiated by you, from your own device.

3.Accounts & eligibility

You must be at least 16 years old to use BriefNest. You’re responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at security@briefnest.ai if you suspect unauthorized use.

You agree to provide accurate account information and to keep it up to date.

4.Subscriptions & billing

Paid plans are billed in advance on a monthly or annual basis, as selected at checkout. Unless stated otherwise on your plan, we do not charge per-seat surprise fees or impose hidden AI-minute caps — the limits that apply to your plan are disclosed at time of purchase on our pricing page.

  • Subscriptions renew automatically until cancelled.
  • You can cancel anytime from Account settings; cancellation takes effect at the end of the current billing period.
  • Fees are non-refundable except where required by law or explicitly stated in a plan’s terms.
  • We may change pricing with at least 30 days’ notice before it applies to your next renewal.

5.Acceptable use

You agree not to:

  • Use BriefNest to record any conversation without the legally required consent of participants in your jurisdiction;
  • Reverse-engineer, decompile, or attempt to extract the underlying models or source code of the Service;
  • Use the Service to build a competing product, or to scrape or bulk-export data for that purpose;
  • Upload content that is unlawful, infringing, or that you do not have the rights to share;
  • Interfere with, overload, or attempt to gain unauthorized access to the Service or its infrastructure.

We may suspend or terminate accounts that violate these Terms.

6.Consent to record

We recommend announcing at the start of a meeting that it is being recorded and summarized by BriefNest.

7.Your content

You retain ownership of the recordings, transcripts, notes, and other material you submit to BriefNest (“Your Content”). You grant BriefNest a limited license to host, process, and analyze Your Content solely to provide and improve the Service to you — for example, generating a brief or answering a question you ask about it.

We do not sell Your Content, and we do not use your meeting audio or transcripts to train AI models shared across customers, as described further in our Privacy Policy.

8.AI-generated output

Briefs, summaries, action items, and answers generated by BriefNest are produced by automated systems and may contain errors, omissions, or misattributions. BriefNest is a drafting aid, not a certified record of what was said. You’re responsible for reviewing AI-generated output before relying on it for decisions, commitments, or compliance purposes.

9.Intellectual property

BriefNest and its logos, product names, and underlying software are owned by BriefNest, Inc. and protected by intellectual property laws. These Terms don’t grant you any rights to our trademarks or branding beyond what’s needed to use the Service as intended.

10.Third-party integrations

BriefNest integrates with third-party services such as Slack, Notion, Linear, and Jira at your direction. Your use of those integrations is also subject to the third party’s own terms. We’re not responsible for how third-party services handle data once it leaves BriefNest.

11.Termination

You may stop using the Service and delete your account at any time from Account settings. We may suspend or terminate your access if you materially breach these Terms, with notice where practical. Upon termination, your right to use the Service ends; data deletion is handled as described in our Privacy Policy.

12.Disclaimers & limitation of liability

The Service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. To the maximum extent permitted by law, BriefNest will not be liable for indirect, incidental, special, or consequential damages, or for any decisions made in reliance on AI-generated summaries. Our aggregate liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

13.Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.

14.Changes to these terms

We may update these Terms from time to time. If a change is material, we’ll notify you by email or an in-product notice before it takes effect. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
